Terms of Service

These Terms of Service ("Terms") govern your use of the FamEase website (famease.in), mobile application, and services operated by SmiRox Ventures LLP ("FamEase", "we", "us", or "our"). By accessing or using our services, you agree to be bound by these Terms.

1. Services

FamEase provides post-death documentation assistance, asset settlements, insurance claim coordination, property transfers, and related administrative services in India. The specific scope of services for your case will be agreed upon in a separate service agreement or engagement letter.

We act as a facilitating service — we do not provide legal, financial, or tax advice. For legal matters, we recommend consulting a qualified legal professional.

2. Eligibility

By using our services, you confirm that:

You are at least 18 years of age.
You are legally authorised to act on behalf of the deceased's estate or family (e.g. as a legal heir, nominee, or authorised representative).
The information and documents you provide to us are accurate and genuine.

3. Client Responsibilities

You agree to:

Provide accurate, complete, and truthful information and documentation required for your case.
Notify us promptly of any changes relevant to your case.
Cooperate with our team and respond to requests in a timely manner.
Not use our services for any fraudulent, unlawful, or improper purpose.

4. Fees & Payment

All fees are agreed upfront in writing before work commences.
For individual services: 50% advance payment is required to begin, and the remaining 50% is due upon completion.
For packages: payment terms will be specified in your service agreement.
We charge fixed fees only. We do not take any percentage of asset values, insurance payouts, or settlements.
All fees are exclusive of government fees, stamp duties, notary charges, or other third-party costs incurred on your behalf, which will be communicated separately.

5. Timelines

Timelines provided are estimates based on typical case complexity and government processing times. We are not liable for delays caused by government offices, banks, courts, or other third-party institutions. We will keep you informed of progress throughout your case.

6. Confidentiality

We treat all case-related information and documents as strictly confidential. We will not disclose your information to any third party except as necessary to provide our services (e.g. submitting documents to banks, government offices) or as required by law.

7. Limitation of Liability

To the maximum extent permitted by law:

FamEase is not liable for decisions made by government authorities, financial institutions, or courts regarding your case.
We are not liable for losses arising from delays caused by third-party institutions.
Our total liability to you for any claim is limited to the fees paid by you for the specific service in question.

8. Intellectual Property

All content on the FamEase website — including text, graphics, logos, and code — is the property of SmiRox Ventures LLP. You may not reproduce, distribute, or use our content without prior written permission.

9. Termination

Either party may terminate the service engagement with written notice. In such cases, fees will be charged on a pro-rata basis for work completed. Advance payments for uncompleted work will be refunded at our discretion based on work done.

10. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the jurisdiction of courts in India.

11. Changes to These Terms

We may update these Terms from time to time. Updated terms will be posted on this page. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
